UPDATE: Response to Sept 15, 2023 HOA Wide Email

In early 2022, Harvest Creek Homeowners began noticing massive discrepancies in financial documents and poor accounting practices by the Property Management Company. At the Annual Meeting in November 2022, the Harvest Creek Homeowners in attendance demanded more transparency from the HOA Board of Directors and the Property Management Company through increased communication to homeowners and a full audit of the HOA’s finances in their entirety. In April 2023, a group of concerned homeowners emailed the Board a request to attend a board meeting along with a series of questions regarding the HOA. As of September 2023, all of these requests have been denied by the HOA Board Members, the Property Management Company, and the HOA Attorney. 

 

All Harvest Creek Homeowners MUST attend this Annual Meeting to ensure that the Board of Directors and the Property Manager are held responsible to their fiduciary duty as OUR representatives who are in charge of OUR money. If you are unable to attend the Annual Meeting in-person, please fill out the Proxy Request Form to ensure your vote is counted and your voice is heard.

Know Your Rights

* All figures are based on Financial statements created and provided by the Property Management Company. The ability to authenticate the data has been limited by the Board of Directors, the Property Manager, and the HOA's Attorney's refusal to provide the HOA's bank statements.

Have you ever received a “balance forward” of $25 on a fully paid invoice for your quarterly dues?

  • In Accounting, a “balance forward” means that there is an “unpaid balance” on a previous invoice. These “balance forward” line items have appeared numerous times on Harvest Creek Owners invoices. When the owners contact the Property Manager as to why there is a “balance forward” on an invoice that the owner has fully paid, the Property Manager has said that it is actually a “late fee.” 

  • In Accounting, a “late fee” and a “balance forward” are two very different things. The “late fees” that the Property Manager is charging have not been authorized by the Board of Directors according to the past three years of documents, meeting minutes, and contracts. 

  • The “late fees” are also in violation of the notification period as outlined by Harvest Creek HOA Covenants & By-Laws regarding the payment and collection of dues. 

  • The Property Manager is taking 50% of these late fees so it is in their best interest to set up their accounting system to automatically charge late fees.

  • From 2020, the Property Management Company has collected $20,407* in late fees without board approval in violation of the Harvest Creek by-laws.

Have you ever been contacted by the Property Management Company for parking (campers, boats, dumpsters, etc..) on the city street?

  • The streets that are in the Harvest Creek HOA are owned and maintained by the City of Bozeman.  The HOA does not have authority over the city streets.  At no time can the HOA fine a member of the HOA for anything that is in or on a city street.

  • The City of Bozeman does have ordinances in place that limit parking on the city street to 72 hours.

  • We would like to note, that we as Homeowners take pride in our neighborhood and request that all Homeowners follow the city ordinances and HOA by-laws.

Did you know that since 2020, the Property Management Company has collected $37,022* over the budgeted management fee total of $34,800/year?

  • Each year at the annual meeting the Homeowners are presented with a yearly budget showing last year's budget and a potential budget for the next year.  At every annual meeting since 2020, that budget has shown $17,400 for Management and $17,400 for Bookkeeping, for a total of $34,800 to be paid to the Property Management Company. 

  • In 2020 the Property Management Company paid themselves $40,986* instead of $34,800.

  • In 2021 the Property Management Company paid themselves $47,070* instead of $34,800.

  • In 2022 the Property Management Company paid themselves $52,414* instead of $34,800.

  • At the annual meeting in 2022, the Property Management Company stated to the Homeowners that they would lower their fees in 2023. However, the Board instead voted in May 2023 to increase the amount paid to the Property Management Company.

Did you know that Harvest Creek HOA is charged triple the amount of what other Bozeman HOAs are charged to file liens by the same Property Management Company for a total of $20,385* since 2020?

  • The Property Management Company charges Harvest Creek $150 to file a lien on a Homeowner, and another $150 to eventually remove said lien for a total of $300 charged to the HOA.

  • The Property Management Company does pass the bill onto the Homeowner when they pay all past due amounts, but then keeps 50% of what the homeowner pays, resulting in a net loss of $150 for the HOA.

  • The Property Management Company only charges other HOAs $50 to file a lien and $50 to remove a lien.

  • The HOA's by-laws require the Chairman of the Board of Directors to sign all liens that are approved by the Board.  No liens have been approved or properly signed since 2019.

  • This has resulted in Harvest Creek paying $20,385* more than it should since 2020.

Did you know that other Bozeman HOAs only pay $35 for Architectural review applications and Harvest Creek Homeowners have to pay $200?

  • Many HOA Covenants and By-Laws allow for an Architectural Review Committee to oversee changes within the HOA. Most HOAs charge a nominal fee of $25 - $50 to review large scale projects that may require a licensed architect to review building plans, landscaping, fencing, or additional construction projects within the HOA. Several local Bozeman HOAs charge $35 to pay an architect to review building plans.

  • The $200 fee was not approved by the Harvest Creek HOA Board in any documents, meeting minutes, or contracts for the past three years.

Did you know that the Property Management Company profits off of charging Harvest Creek Homeowners late fees, fines, and liens?

  • The Property Management Company is currently keeping 50%+ of late fees, fines, and liens charged to Harvest Creek homeowners.

  • From January 2023 through July 2023 the Property Management Company charged Homeowners $4,382.50* for late fees and kept $2,250* or 51.3%.

  • In 2022 the Property Management Company charged $1,300* in fines and kept $650*.

  • As of July 2023 the Property Management Company charged the HOA $750* to release liens, but financial statements do not show any income from Homeowners paying to release the lien, resulting in the Property Management Company keeping all $750* so far for 2023.
