How Many Months in a Year?


Let's be real. Many people may have felt that 2021 lasted for a good long 14 months, but it still only had 12 months in it.


Based on a review of the Harvest Creek HOA financial documents, Harvest Creek HOA has paid overpaid $16,939.51 in management fees because there are apparently 14 months in 2021 and 13 months in 2022.


A contract exists between Saddle Peak Properties and Harvest Creek. That contract stipulates a start date of October 1, 2019, even though it was not "signed" until December 2019. The first payment from Harvest Creek to Saddle Peak Properties is dated October 7th, 2019. One can only assume that the October 7th, 2019, management fee payment is for the first month of the contract - October 2019 - and move from there.


As you can see in the table below there are no real problems. Occasionally, money is withdrawn from the account a day or two ahead of the month, but nothing really out of the ordinary. 12 payments in 12 months. This table is mostly to show that the payments are fairly regular around the beginning of the month that the payment is for.

The last payment in November of 2020 was for December 2020. As you can see in the next table, the payment for January 2021 was made a couple of days early in December 2020. But then in January, the payments change to being almost 10 days early. The real problems happen in June when 3 payments are all made for the monthly management. All three payments for June either have an invoice stating that the amount is for the monthly management, or the check itself has a memo stating it is for monthly management.


Why did we pay an extra $10k+ in June 2021 for management?


Why did Harvest Creek pay Saddle Peak Properties 14 monthly management fees in 2021?

Just to keep things simple we are going to assume that the payment in January 2022 below is for January 2022. Once again, the entire year is pretty straight forward will all monthly management fees being paid around the beginning of the month. The one big exception is an extra payment on April 25th. What is this for?


One might reason that the extra payment might be for all of the other things that Harvest Creek pays to Saddle Peak Properties during the year, i.e.. liens, 50% of late fees, postage, or office supplies, etc. However, all of those other categories are accounted for in the other monthly payments and sum up to about what is in the yearly P&Ls. This payment is simply an extra payment that is unaccounted for in any financial document provided to any Harvest Creek HOA homeowners.


What is the extra payment for? It is strange that it is for about the same amount as the other monthly management fees.

Going forward into 2023 and 2024, once homeowners started watching the management company, all of the monthly management fees are paid on a fairly regular schedule around the beginning on the month with no extra payments.


Remember that time when (September 17, 2023 board meeting) the then Harvest Creek HOA treasurer Mike Roser called concerned homeowners "numb nuts" and said "so if you're not skimming any money off the top, we'll be ok" to Lindsay Freitas.


The Harvest Creek HOA Board of Directors has frequently said everything is just fine regarding Harvest Creek HOA financials, but is it? Really? How many months are in a year?

  • Did Harvest Creek Board of Directors knowingly allow for 14 monthly payments for management fees?

    or

  • Is the Harvest Creek HOA Board of Directors not actually monitoring Harvest Creek HOA funds and not reviewing and approving all invoices to be paid and were thus unaware of additional management fees being removed from the Harvest Creek HOA funds?
