Members of the Harvest Creek HOA have signed a petition to call a Special Meeting of the HOA on Tuesday, June 4th, 2024 at 6:00pm at the Bozeman Public Safety Center and via google meet

You may have received a notice from Saddle Peak Properties and the unnamed “Harvest Creek HOA Board of Directors'' attempting to silence the Harvest Creek Homeowners by taking it upon themselves to “cancel” the duly called special meeting on Tuesday, June 4th, 2024 at 6:00pm at the Bozeman Public Safety Center.
But this is not true. The email from the “Board of Directors” states that the petition “did not have enough of a quorum to request a special meeting”. However, per Montana state law which will trump any covenants and by-laws,
MCA 35-2-527 Special meeting. (1) A corporation with members shall hold a special meeting of members:...(b)...if the holders of at least 5% of the voting power of any corporation sign, date, and deliver to any corporate officer one or more written demands for the meeting that describe the purpose or purposes for which it is to be held.
A demand of 35 holders was given to the board. Harvest Creek has 530 lots. 35 / 530 = 6.6%. At 6.6% the legal requirements to call a Special Meeting have been met and the Special Meeting on Tuesday, June 4, 2024 at 6:00PM WILL be held.
The Board and Saddle Peak Properties do not want you to talk to your neighbors.
The Board and Saddle Peak Properties do not want you asking questions about operations, financials, vendor contracts, board elections, liens, late fees, architectural review committee fees, financial double dipping, contract violations, meeting minutes, actions by the Board without a meeting, legal fees, contractual fees vs. “add-on” fees, about where the Harvest Creek HOA bank account is, whose name the account is in, and how does the money in the account track with what is being reported.
The Board and Saddle Peak Properties do not want you to talk to vendors who allegedly provide services to Harvest Creek HOA and get paid by Harvest Creek HOA but don’t have contracts with Harvest Creek HOA which violates Harvest Creek by-laws.
The Board and Saddle Peak Properties do not want you to talk to other Bozeman HOAs operated by Saddle Peak Properties who also started questioning major discrepancies in their own HOA financials.
The Board and Saddle Peak Properties do not want you to do the math on the financials so they stopped sending out quarterly financial reports and the end-of-year financial statement.
So now you have to ask yourself “WHY?”
If the Board of Directors actually “acknowledges some of the concerns brought up by the homeowners, and seeks to better the relationship between the Board and homeowners”
Why wouldn’t the board just show up to the June 4th meeting? It has been scheduled in accordance with Montana state law, a venue has been secured, and homeowners will be in attendance.
Why has the board refused to hold open board meetings since financial and operational concerns started arising years ago and homeowners asked for open meetings, more transparency, more communication and instead got less transparency, less frequent communication, and no open board meetings?
If the Board was truly concerned, why would CJ Cook and James Connolley refuse to do their fiduciary duty and take the time to locate the Harvest Creek HOA bank accounts and verify the details of the bank account against financial statements being reported by Saddle Peak Properties?
If the board was truly concerned, why wouldn’t they complete a complete financial audit as demanded by the Harvest Creek homeowners in 2022 instead of the audit that verified 3 checks were cashed?
Why wouldn’t the Board communicate directly with homeowners instead of hiding behind lawyers and property managers?
