No Confidence Vote PASSES


To whom it may concern:


On June 4, 2024, a Special Meeting of the Harvest Creek HOA was held at the Bozeman Public Safety Center.  At this Special Meeting, the current Board of Directors of Barbara Pastine, CJ Cook, and James Connolley did not receive the required 266 votes to confirm them to the Harvest Creek Board of Directors in accordance with Harvest Creek Bylaws.  Additionally, a vote of “No Confidence” was motioned and seconded to formally remove Barbara Pastine, James Connolly, and CJ Cook from the Harvest Creek Board of Directors. The motion received 41 votes in favor and zero votes opposing.  It has been well established that a quorum of the membership is 30% or 159 members.  Article II.9 of the Covenants allows for the solicitation of votes to assent to any motion that is favored by a majority of the votes cast at the meeting.  Said votes are to be delivered to the appropriate officer of the Association no later than 30 days from the date of the meeting.


We, the homeowners of the Harvest Creek Owners’ Association, do hereby submit 172 votes for the motion of “No Confidence” to formally remove Barbara Pastine, James Connolly, and CJ Cook from the Harvest Creek Board of Directors with 146 votes in favor, 3 votes against, and 23 abstentions. Barbara Pastine, James Connolly, and CJ Cook are formally removed from the Harvest Creek Board of Directors effective immediately.


Only the Board of Directors can approve monies to be spent from the HOA accounts. In violation of the Harvest Creek Bylaws, no 2024 budget was approved by membership at the Annual Meeting meaning that there are no authorized expenditures for 2024. Without a Board and no approved 2024 budget, no monies can be approved so no monies shall be withdrawn from the Harvest Creek bank accounts, including certificates of deposit, effective upon receipt of this notification on Wednesday, July 3rd, 2024.


Additionally, in accordance with Harvest Creek Bylaws, only the Board of Directors can approve fines, late fees, and/or liens.  In the absence of the Board, no fines, late fees, or liens can be approved, and none shall be charged to Harvest Creek homeowners effective immediately.


We look forward to seeing all homeowners on July 10, 2024, at 6:00pm at the Bozeman Public Safety Center for another Special Meeting of the Harvest Creek HOA.
