The Truth About Harvest Creek's Bank Accounts

For years, Harvest Creek Homeowners have been concerned about the status of the Harvest Creek HOA Bank Accounts and who exactly is listed as the owner on the bank accounts.


Prior to May, 2021, the Harvest Creek HOA had bank accounts at First Security Bank.


Saddle Peak Properties closed Harvest Creek HOA Bank Accounts at First Security Bank and opened new bank accounts at Stockman Bank on May 13, 2021. There are no documents showing that the Harvest Creek HOA Board of Directors ever approved of the closing of the Harvest Creek HOA's original First Security bank accounts.


When homeowners questioned Stockman Bank about the existence of Harvest Creek bank accounts, Stockman Bank reviewed their accounts and stated that there are no bank accounts in Harvest Creek HOA's name (i.e. Harvest Creek is not listed as an owner on any Stockman Bank accounts).


In a meeting on July 10, 2024, former Board Member CJ Cook stated that "Barbara has historically been on the bank account there. We have a checking and a savings account, it is titled Harvest Creek HOA in trust of Saddle Peak. So it's a trust account, right, it's our money...We added James Connolly on the bank account."


Stockman Bank Origination Documentation

Homeowners have been provided the bank account origination documentation regarding the alleged Harvest Creek HOA's bank accounts at Stockman Bank.

Stockman Bank Savings Account


Origination Document A shows that a business savings account (######7135) was opened on May 13, 2021, listing ITF Harvest Creek HOA as the owner of the bank account with an EIN (tax id) ending in ##-###5084. The owners/signers on the account are: Lindsey Frietas & Cody Frietas. There are no Harvest Creek HOA board members listed as signers on the business savings bank account. This contract was not signed by any member of the Harvest Creek HOA Board of Directors.


On July 31, 2024, Hudson Hart was added as an owner/signer to Stockman Business Savings Account. At this time, the owner of the savings account (######7135) changes from ITF Harvest Creek HOA to Saddle Peak Properties and the EIN associated with Harvest Creek (##-###5084) is changed to the EIN associated with Saddle Peak Properties (##-###2629).


These documents suggest that a savings account (######7135) was once owned by Harvest Creek HOA until July 31, 2024 when it was signed over fully to Saddle Peak Properties.

It now appears that Harvest Creek HOA no longer owns a savings account at Stockman Bank.


Stockman Bank Checking Account


Origination Document B shows that an essential business checking account (######3242) was opened on May 13, 2021, listing Saddle Peak Properties as the owner of the bank account with an EIN (tax id) of ##-###2629. The owners/signers on the account are: Lindsey Frietas & Cody Frietas. There were no Harvest Creek HOA Board Members listed as owner/signers on the bank account until July 31, 2024 when Hudson Hart was added as a signer. While Hudson is a signer on a checking account, these documents suggests that Harvest Creek HOA has not now nor ever owned an essential business checking account at Stockman Bank.


Stockman Bank Certificate of Deposit


Origination Document C shows that a Certificate of Deposit for $50,000 created on August 2, 2024. The owner is clearly listed as Harvest Creek Homeowners' Association, Inc. as the owner of the account with the EIN ending in ##-###5084 which seems to be associated with Harvest Creek HOA.

Stockman Bank Internal Use Field

Stockman Bank has confirmed that the above "Account Title & Address" is a field that the accounts owner can type anything into. Like when your credit card asks you for an account "nickname" so you can remember which card to use or if you want to give a nickname to your "emergency savings" bank account. It does not indicate ownership of the account nor does it change an "essential business checking account" magically into a "trust account."


This documentation validates the Harvest Creek Homeowners concerns regarding OUR MONEY.


Here are the facts according to the provided documentation. If anyone wants to provide documentation to support or contradict these facts, email harvestcreekhoa@gmail.com and they will be posted.


  • These business checking and business savings bank accounts are not and have never been "trust accounts" contrary to the assertations made by CJ Cook on July 10th, 2024.

  • Contrary to the statements made by CJ Cook on July 10th, 2024 and the above documents, Barbara Pastine has NEVER been an owner/signer ON the checking or savings account associated with Harvest Creek HOA. She may have had read only access, but she has NEVER been listed on the accounts.

  • The records do not show that James Connolly was ever added to any savings or checking accounts associated with Harvest Creek HOA contrary to statements made by CJ Cook. He may have had read only access, but he has NEVER been listed on the accounts.

  • The Stockman Bank Checking Account (3242) has never belonged to Harvest Creek HOA. It has always belonged to Saddle Peak Properties.

  • The Stockman Bank Savings Account (7135) did belong to Harvest Creek HOA; however, according to documents, it was signed over to Saddle Peak Properties on July 31, 2024, when Hudson Hart was added as an owner/signer.

  • As of November 11, 2024, the only Stockman Bank account that appears to be in the name of Harvest Creek HOA is a $50,000 Stockman Bank Certificate of Deposit with Hudson Hart as the sole signer.


Why is OUR MONEY being placed into bank accounts that are owned solely by Saddle Peak Properties?

Why have there never been any Harvest Creek HOA Board Members as owners/signers on the accounts until July 2024?


Why has there been absolutely ZERO oversight into the financial situation of Harvest Creek HOA? Why are Board Members providing information to Harvest Creek Homeowners that is not accurate based on these origination documents?


Demand that the Harvest Creek HOA bank accounts be placed solely in Harvest Creek HOA's name.

Demand that the Harvest Creek HOA due their required fiduciary duty per the Harvest Creek By-Laws, Covenants, and state law and protect Harvest Creek HOA's funds.


Demand that the Harvest Creek HOA provide the transparency, open communication, open board meetings, committees, and integrity that homeowners have been demanding for years!
