This just in…the Harvest Creek Treasurer is missing!
Jumping into the way back machine, on April 11th, 2023, homeowners asked Barbara Pastine, Mike Rouser, and Scott Bosse who the Harvest Creek President, Secretary, and Treasurer were in accordance with Montana Code Annotated and Harvest Creek Covenants. Zero response.
Jumping forward a year to April 19th, 2024, another Harvest Creek homeowner pointed out to CJ Cook, Barbara Pastine, and James Connolly that the Harvest Creek HOA Board of Directors is required to have a President, Secretary, and Treasurer. They did not respond.
On May 1st, 2024, a Harvest Creek homeowner emailed Alanah Griffith, CJ Cook, Barbara Pastine, and James Connolly asking for clarification on who the Harvest Creek Board of Director Officers are including President, Vice President, Secretary, and Treasurer. Surprise….no response.
The request for the list of the current officers of the Harvest Creek Board of Directors was asked again to Alanah Griffith, CJ Cook, Barbara Pastine, and James Connolly on June 3rd, 2024. Zero response. Notice a pattern?
On June 26th, 2024, the Harvest Creek Board of Directors Board Meeting Minutes state that:

Any beginning gumshoe with a computer and internet connection can google Montana Code Annotated or the Montana Nonproft Association. Easily accessible to the public. No expensive law degree needed.
That is where you will find Montana Code Annotated 35-2-439 where it states:

Harvest Creek Covenants & Bylaws
What can also be found online at the Saddle Peak Properties website are the Harvest Creek Covenants & Bylaws.
Harvest Creek Covenants Section 6 outline the required officers for the Harvest Creek Board of Directors as a President, Vice President, Secretary/Treasurer.

In a letter dated July 8th, 2024th, Alanah Griffith stated that "The rule of thumb is that Covenants trump Bylaws as they run with the land and therefore have more power."
Per Montana Code Annotated and the Harvest Creek Covenants, the Harvest Creek Board of Directors SHALL have a Treasurer.
Now why wouldn’t Barbara Pastine, CJ Cook, or James Connolly want to be the Harvest Creek Board of Directors Treasurer? Perhaps it is the 100+ financial discrepancies brought forth by concerned homeowners years ago.
The last Treasurer that homeowners are aware of was Mike Rouser who can be seen in the September 27, 2023 meeting calling homeowners “numbnuts” for asking questions about serious discrepancies in the Harvest Creek HOA financials. And yet, in the same meeting when questions are asked about contracts and the financial requirements of those contracts, the Treasurer remains silent and does not seem to have any answers. He goes so far to say "as long as she is not skimming off the top." He also states that concerned homeowners "better get their own attorneys." You can watch those little tidbits here.
When the former board members of CJ Cook, Babarba Pastine, and James Connolly or Alanah Griffith make claims that homeowners are costing the association tons of money in legal fees just remember this - two attorneys licensed to practice law in the state of Montana determined that the Harvest Creek Board of Directors doesn’t need a Treasure in contradiction to Montana state law and the Harvest Creek Covenants which you all signed and agreed to abide by.
Again, per Montana Code Annotated and the Harvest Creek Covenants, the Harvest Creek Board of Directors SHALL have a Treasurer.
